Conditions for withdrawal

Information on exercising the right of withdrawal pursuant to Article 52 of the Consumer Code

Withdrawal

Subject to the exclusion cases provided in point VII below, the Consumer Customer has the right to withdraw from the contract for any reason, without having to provide explanations and without any penalty ("Right of Withdrawal" or "Withdrawal").

The Withdrawal may concern all or only part of the Products purchased by the Consumer Customer.

The Right of Withdrawal can be exercised within 14 days from the date on which the Consumer Customer, or the third party designated by them, received the Products.

To exercise the Right of Withdrawal, the Consumer Customer must send the Seller, within the aforementioned period, a communication containing the data indicated in the form downloadable here.

This communication must be sent by registered letter with return receipt, addressed to:

Once the Withdrawal communication is received, the Seller's customer service will communicate the case number and instructions for returning the Products to the Consumer Customer via email.

The Right of Withdrawal is governed by the following conditions:

I. The Right of Withdrawal applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the Withdrawal only on a part of it.

II. In case of timely exercise of the Right of Withdrawal, the Seller will refund the Consumer Customer the entire price of the Products (including any Accessory Costs) subject to Withdrawal (the "Returned Products") within 14 days from the date of receipt of the Withdrawal communication. The Seller will have the right to suspend the refund until receipt of the Returned Products or until the Consumer Customer proves that they have shipped them, whichever occurs first.

III. The refund will be made using the same payment method used by the Consumer Customer, unless they have expressly requested a different refund method, provided it is not more expensive for the Seller.

IV. The Consumer Customer who has communicated the Withdrawal within the time frame and in the manner indicated above will be required to return the Returned Products to the Seller within and no later than 14 days from sending the Withdrawal communication.

V. All costs necessary for returning the Returned Products are borne by the Consumer Customer; the return of the same is under the complete responsibility of the Consumer Customer.

VI. The Products must be returned intact and in normal conservation condition, inserted in the original packaging, complete with all their parts (including packaging and accessory documentation).

VII. The Right of Withdrawal is excluded, as well as with reference to sales made to Professional Customers, also in the following cases pursuant to Article 59 of Legislative Decree 21/2014 and subsequent amendments:

  • Products that risk deteriorating or expiring rapidly (e.g., fresh and perishable food products);
  • Sealed products that are not suitable for return for hygienic or health protection reasons or that have been opened after delivery.

Refund

The customer service of Sud Rienergy Società Agricola S.r.l. will acknowledge your communication by indicating the case number and instructions for returning the products, and you must proceed to ship the product intact and in normal conservation condition, inserted in the original packaging, complete with all its parts (including packaging and accessory documentation), within 14 days from the date you communicated your decision to withdraw to Sud Rienergy Società Agricola S.r.l..

Sud Rienergy Società Agricola S.r.l. will refund an amount equal to the purchase price of the Products (including delivery costs and any accessory charges) within 14 days from the day it was informed of the decision to withdraw from the contract. Sud Rienergy will have the right to suspend the refund until it receives the products subject to withdrawal or until you prove that you have shipped them, whichever occurs first.

However, the direct costs for returning the products and any accessory charges, if due, will be at your expense.

The refund by Sud Rienergy Società Agricola S.r.l. will be made using the same method you chose when placing the order or with the different method you requested at the time of withdrawal communication, provided it is not more expensive for Sud Rienergy Società Agricola S.r.l.. The withdrawal will not be effective if it has not been exercised in accordance with the General Terms of Sale of Sud Rienergy Società Agricola S.r.l. to which reference is expressly made.
