7. Legal Guarantees

The legal guarantees identified below will apply in all cases where they are not incompatible with the nature of the Product purchased or its shelf life indicated on the label (i.e., the period during which the Product maintains an acceptable level of safety and quality).

Legal guarantee for the Consumer Customer: the Consumer Customer has the right to take advantage of the legal guarantee provided by articles 128 to 132 of the Consumer Code. This guarantee provides, among other things, that the Consumer Customer, under penalty of forfeiture, must report any lack of conformity of the Product to the Seller within 2 months from its discovery (art. 132, Consumer Code). Following this complaint, the Consumer Customer will have the right to request the repair or replacement of the defective Product, without prejudice to the other rights provided by law in their favor. Under the aforementioned guarantee, the Seller is responsible for conformity defects that occur within 2 years from the delivery of the Product. Beyond this term, the Seller will therefore not be liable for any conformity defects found by the Consumer Customer. In the event of replacement or repair of the Product, the terms of the guarantee relating to the replaced or repaired Product remain the same as those of the original product. Therefore, the two-year duration of the legal guarantee will still commence from the delivery of the original Product. To benefit from the guarantee, the Consumer Customer must provide evidence of the date of purchase.

Legal guarantee for the Professional Customer: the Professional Customer has the right to take advantage of the legal guarantee provided by the Civil Code. This guarantee provides, among other things, that the Professional Customer, under penalty of forfeiture, must report any lack of conformity of the Product to the Seller within 8 days from its discovery. This guarantee will remain in force for 12 months from the delivery of the Product. Therefore, beyond this term, the Seller will not be liable for any conformity defects. To benefit from the guarantee, the Professional Customer must provide evidence of the date of purchase.

8. Errors and Limitations of Liability

The information relating to the Products is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which the Seller cannot be held responsible, except in cases of willful misconduct or gross negligence.

The Seller reserves the right to correct any errors, inaccuracies, or omissions even after an order has been confirmed, or to modify or update the information at any time without prior notice.

The Customer will not be entitled to compensation for damages or recognition of indemnities as a result of non-acceptance or non-fulfillment, even partial, of an order.

The Seller also disclaims any liability for direct or indirect damages of any kind or in any form, resulting from the use of the Website and/or the news, photos, and information contained therein.

The sales contract between the Customer and the Seller is understood to be concluded in Italy and is governed by Italian law. Any disputes that may arise between the Seller and a Consumer Customer in relation to the purchase of Products will be referred to the exclusive jurisdiction of the court of residence or domicile of the Consumer Customer, if located in Italian territory; in all other cases, the exclusive territorial jurisdiction will be assigned to the Court of Padua.
