Information Regarding the Exercise of the Right of Withdrawal Pursuant to Art. 52 of the Consumer Code

Withdrawal

Without prejudice to the exclusions provided for in point VII below, the Consumer Customer has the right to withdraw from the contract for any reason, without the need to provide explanations and without any penalty ("Right of Withdrawal" or "Withdrawal").

The Withdrawal may concern all or only part of the Products purchased by the Consumer Customer.

The Right of Withdrawal may be exercised within 14 days following the date on which the Consumer Customer, or a third party designated by them, received the Products.

To exercise the Right of Withdrawal, the Consumer Customer must send the Seller, within the aforementioned period, a communication containing the information indicated in the form downloadable here.

This communication must be sent via registered letter with return receipt, addressed to:

Once the Withdrawal communication has been received, the Seller's customer service will notify the Consumer Customer via email of the case number and the instructions for returning the Products.

The Right of Withdrawal is subject to the following conditions:

I. The Right of Withdrawal applies to the Product purchased in its entirety; therefore, if the Product consists of multiple components or parts, it is not possible to exercise the Withdrawal for only a part of it.

II. In case of timely exercise of the Right of Withdrawal, the Seller will refund the Consumer Customer the entire price of the Products (including any Additional Charges) subject to the Withdrawal (the "Returned Products") within 14 days from the date of receipt of the Withdrawal communication. The Seller will have the right to withhold the refund until the Returned Products are received or until the Consumer Customer provides proof of having shipped them, whichever comes first.

III. The refund will be made using the same payment method used by the Consumer Customer, unless the Consumer Customer has expressly requested a different refund method, provided that it is not more burdensome for the Seller.

IV. The Consumer Customer who has communicated the Withdrawal within the specified period and in the manner outlined above must return the Returned Products to the Seller no later than 14 days after sending the Withdrawal communication.

V. The Consumer Customer bears all costs necessary for returning the Returned Products; the return is the full responsibility of the Consumer Customer.

VI. The Products must be returned intact and in their normal state of preservation, in their original packaging, complete with all their parts (including packaging and any accompanying documentation).

VII. The Right of Withdrawal is excluded, in addition to sales made to Professional Clients, in the following cases pursuant to Art. 59 of Legislative Decree 21/2014 and amendments:

  • Products that are liable to deteriorate or expire rapidly (e.g., fresh and perishable food products);
  • Sealed products that are not suitable for return for health or hygiene reasons or that have been opened after delivery.

Refund

Sud Rienergy Società Agricola S.r.l.'s customer service will respond to your communication, providing the case number and instructions for returning the products, and you must proceed with shipping the product intact and in its normal state of preservation, in its original packaging, complete with all its parts (including packaging and accompanying documentation), within 14 days from the date you communicated your decision to withdraw to Sud Rienergy Società Agricola S.r.l.

Sud Rienergy Società Agricola S.r.l. will refund the amount equal to the purchase price of the Products (including delivery costs and any additional charges) within 14 days from the day it was informed of your decision to withdraw from the contract. Sud Rienergy has the right to withhold the refund until the returned products are received or until you provide proof of having shipped them, whichever occurs first.

However, you are responsible for the direct costs of returning the products and any applicable additional charges.

The refund from Sud Rienergy Società Agricola S.r.l. will be made using the same method you chose when placing the order or, if requested in the withdrawal communication, using an alternative method, provided it is not more costly for Sud Rienergy Società Agricola S.r.l. The withdrawal will not be effective if it has not been exercised in accordance with the terms set out in the General Terms of Sale of Sud Rienergy Società Agricola S.r.l., which are expressly referred to herein.
